1. Agreement to Terms

By accessing or using InkStantAI ("the Service") at inkstantai.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and InkStantAI ("we," "us," or "our"). We may update these Terms at any time with 30 days' prior notice. Continued use after changes take effect constitutes acceptance of the modified Terms.

2. Service Description

InkStantAI is an AI-powered book generation platform that enables users to create Amazon KDP-ready books including manuscripts, cover designs, and publishing metadata. The Service uses third-party artificial intelligence models (including Anthropic Claude and OpenAI) to generate content based on user-provided topics and preferences.

The Service is available in four subscription tiers:

  • Free — 1 book (30 pages max), PDF + ePub, English only
  • Starter ($19/mo) — 2 books/month (up to 100 pages each), all 4 languages, KDP metadata
  • Creator ($49/mo) — 8 books/month (up to 200 pages each), priority queue, Print-Ready Pack
  • Pro ($99/mo) — 30 books/month (up to 300 pages each), rush processing, Claude Opus option

3. Account Registration and Security

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information remains accurate and up-to-date

You must be at least 16 years of age to create an account and use the Service.

4. AI-Generated Content and Intellectual Property

4.1 Your Input

You retain all rights to the topics, prompts, and preferences you submit to the Service ("Input"). By submitting Input, you grant InkStantAI a limited, non-exclusive license to process your Input through our AI pipeline for the sole purpose of generating content for you.

4.2 Generated Output

Subject to your compliance with these Terms and payment of applicable fees, we assign to you all rights, title, and interest we may hold in the content generated by the Service ("Output"), including manuscripts, cover images, and metadata. However, you acknowledge and agree that:

  • AI-generated content may have limited copyright protection under current law. The U.S. Copyright Office and many international jurisdictions may not grant copyright protection to purely AI-generated works without sufficient human authorship.
  • Similar or identical Output may be generated for other users who provide similar Input.
  • InkStantAI makes no representations about the copyrightability or exclusivity of any Output.
  • You are solely responsible for reviewing, editing, and verifying all Output before publication or commercial use.

4.3 Amazon KDP Compliance

If you intend to publish Output on Amazon KDP or any other publishing platform, you are solely responsible for:

  • Complying with the platform's guidelines, including disclosing AI-generated content as required by Amazon KDP's policies
  • Reviewing all content for accuracy, factual correctness, and legal compliance
  • Ensuring the content does not infringe on any third-party intellectual property rights
  • Meeting all publishing platform requirements for content quality and formatting

5. Subscriptions and Billing

5.1 Billing

Paid subscriptions are billed monthly in advance. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

5.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will not receive a separate notice before renewal.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your subscription remains active until the end of the current billing period
  • You retain access to all generated content during this period
  • No further charges will be applied
  • Your account reverts to the Free tier after the billing period ends

5.4 Price Changes

We reserve the right to change subscription prices with at least 30 days' advance notice. Price changes will take effect at the start of your next billing period after the notice period.

5.5 Refunds

Refunds are governed by our Refund Policy.

6. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
  • Generate content that infringes on any third-party intellectual property, privacy, or publicity rights
  • Generate content that promotes violence, discrimination, or hatred against any individual or group
  • Circumvent or attempt to circumvent usage limits, rate limits, or other restrictions
  • Resell, redistribute, or sublicense the Service or use it to operate a competing service
  • Generate content in bulk for the purpose of spamming or flooding publishing platforms
  • Introduce malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated tools (bots, scrapers) to access the Service without our written permission
  • Violate Amazon KDP or any other publishing platform's content guidelines

We reserve the right to suspend or terminate accounts that violate these restrictions, with or without notice.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, completeness, or quality of AI-generated content
  • Warranties that generated content is free from factual errors, plagiarism, or copyright infringement
  • Warranties that generated content will be accepted by Amazon KDP or any other publishing platform

You acknowledge that AI-generated content is produced by machine learning models and may contain inaccuracies, biases, or errors. You are solely responsible for reviewing all content before publication.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • InkStantAI shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses
  • Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars ($100)
  • We are not liable for any consequences of publishing AI-generated content, including KDP account suspensions, copyright claims, defamation actions, or financial losses from book sales

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless InkStantAI and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service or any content you generate, publish, or distribute using the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any claim that your Input or your use of Output caused damage to a third party

10. Termination

We may suspend or terminate your account at any time if you violate these Terms, with or without prior notice. You may terminate your account at any time through your account settings.

Upon termination:

  • Your right to use the Service immediately ceases
  • You will have 30 days to download your generated content before it is permanently deleted
  • Any outstanding fees remain payable
  • Sections 4 (IP), 7 (Disclaimers), 8 (Limitation of Liability), 9 (Indemnification), and 11 (Governing Law) survive termination

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the foregoing, if you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection laws, you retain any mandatory rights provided by the laws of your country of residence, and you may bring legal proceedings in the courts of your country of residence.

12. Miscellaneous

  • Entire Agreement — These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and InkStantAI.
  • Severability — If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver — Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or the right to enforce it in the future.
  • Assignment — You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Force Majeure — We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, or third-party service outages.
